According to the lawsuit, the introduction states that the case involved “illegal” use of private financial data in credit reports. Furthermore, the lawsuit states that the “illegal” use of marketing debt settlement and/or consolidation services.

Statement of Facts

In the statement of facts, the Debt Advisors of America lawsuit states that the defendants allegedly engaged in a scheme to obtain that consumer reporting data to market debt settlement and credit repair services.

The lawsuit discusses a mailer that is allegedly deceiving, including text that it’s important to contact the firm within 10 days of receiving the notice to avoid unnecessary delays in processing your request.

The lawsuit further reads that the plaintiff matches one of 3 criteria to receive a mailer.

  1. High debt to income ratio
  2. Accounts open for 12 months
  3. And/or Annual percentage rate (APR) on an account had risen.

What Were the Plaintiff’s Claimed Damages?

According to the lawsuit, the plaintiff suffered actual damages such as (but not limited to), anxiety,monetary damages, and mental and/or emotional hardship, and embarrassment that his private financial data had been reviewed and accessed by individuals or company that did not have a right to that information.

2 Interesting Facts About Debt Advisors of America Lawsuit

I found two interesting fact s about this case:

  1. On page 5, Nate indicated that Debt Advisors of america is actually a broker who would connect him with a law firm to handle the debt. From a bit more research, I found that LPG may stand for Litigation Practice Group that maintains just a 3.7 based on 368 reviews on Google.

  2. You will see that Exhibit A appears to be almost identical to the same mailer (below) that Debt Advisors of America seems to be continuing to use.

These guys are truly a beacon for those of us with too much debt. From the start where I found Ben on the YouTube channel Ascend I have been treated as a real person by real people. Even getting a personal call helping me figure things out. I went through one of the lawyers recommended by Ascend and as of January 2nd I am debt discharged, and already have a great credit card from Mission Lane for $2000. Things are getting back into place and my life feels so much less stressful due to the weight of debt being off my shoulders.

PLEASE give these guys a call if you are even considering any sort of debt relief be it bankruptcy, consolidation, or whatever other types of debt relief are out there.
